Cannabis Retail Price Study

Third-Party Relationships

Senate Bill 74 was passed during the 2025 legislative session, effective October 1, 2025. The bill contains the following language in Section 5 (7):

“A licensee may contract or otherwise engage a third party to perform work on behalf of any aspect of a marijuana business. All third-party relationships must be disclosed to the department before a third party can begin performing work on behalf of any aspect of the marijuana business. An individual performing work for any aspect of a marijuana business must secure a worker permit pursuant to 16-12-226. A licensee is responsible for ensuring a third party is compliant with marijuana laws and is liable for any violations.”

All licensees must disclose the status of any third-party relationships (business and/or individual) associated with their licensed business.

Per ARM 42.39.102(40):

"Performing work on behalf of any aspect of a marijuana business" means and includes:

  1. possessing, handling, producing, propagating, processing, securing, or selling marijuana or marijuana products at the licensed premises;
  2. recording of the possession, handling, production, propagation, processing, securing, or selling of marijuana or marijuana products at the licensed premises; and
  3. the direct supervision of a person described in (a) or (b).

Please note: If no such relationship(s) exists, the licensee must attest accordingly. Contracts with a business already licensed by the division are not required to be disclosed.

Metrc – Sunset of Legacy API

Metrc has made the decision to sunset its legacy API. This will go into effect on December 1, 2025.

Below is important information regarding what to expect moving forward:

  • Sunset date: The official date for sunsetting our API v1 solution is
    December 1, 2025. After this date, the product will no longer be accessible
    or supported, and the ability to make calls on API v1 will no longer be
  • Support and maintenance: Until the sunset date of API v1, Metrc will
    continue to provide support and maintenance for the product as usual.
    This includes addressing any issues or concerns you may have.
  • Further communication: We will keep you updated with any further developments or information regarding this process over the coming months.

Manufacturing Fees

As of October 1, 2025, Manufacturer tiers are per license: Tiers are based on the total amount of concentrate produced by the licensee; they are not determined by each premise. 

  • $5,000 - for less than 1 pound of concentrate and up to 10 pounds
    of concentrate
  • $10,000 - between 10 pounds of concentrate and 15 pounds of concentrate
  • $20,000 - for 15 pounds or more of concentrate
