Power of Attorney and Declaration of Representative (Form POA)

Submitting a Power of Attorney

Your tax records are confidential. We can't give your tax information to anyone without your written consent. Taxpayers who would like to designate someone else to represent them before the Department of Revenue must complete and submit a Power of Attorney (Form POA).

We can only provide information to your tax preparer if:

Important Notes

  • Spouses filing a joint return must each complete a separate form.
  • This form will not be honored for any purpose other than representation before the Department of Revenue. It cannot be used for any other purpose.

Granting Account Access through the TransAction Portal (TAP)

You will need:

  • Access to the internet
  • A TAP account
  • Access to your email or a cell phone with text messaging
  • Your social security number or Montana account ID

Your tax preparer will need:

  • Access to the internet
  • A TAP account
  • Access to their email or a cell phone with text messaging
  • Your last name
  • Your social security number or Montana account ID

Granting Account Access with the Power of Attorney (Form POA)

  • Download the Power of Attorney and Declaration of Representative (Form POA)
  • Be sure to be accurate. We can process an accurate Form POA within one business day.
  • If your Form POA isn't complete or is inaccurate, we will need to contact you to make corrections, which may delay processing.
  • If you are a first-time filer, your Form POA will be delayed while we create your tax account.

Using Federal Form 2848

We will accept Federal Form 2848 in place of our Form POA if Section 3 (Tax Matters) specifies:

  • Montana
  • The tax type
  • The tax form number
  • The applicable years
